The Karnataka High Court has ruled that squeezing the testicles of a person during a fight cannot be considered as attempt to murder.
Parameshwarappa hails from Mughalikat village, Chikkamagaluru district, Karnataka. On March 15, 2010, when the temple festival was going on, he had a fight with Omkarappa. Both are involved in a scuffle. It is said that Parameshwarappa then pressed Omkarappa’s private part.
Following the injury, Omkarappa’s left testicle was surgically removed. Following his distraught complaint, the trial court booked Parameshwarappa under Section 307 of the Indian Penal Code for attempted murder and sentenced Parameshwarappa to seven years in prison.
Parameshwarappa has filed an appeal against this in the High Court of Karnataka. In it, “There was a large crowd at the festival. Anyone can press Omkarappa’s private part in a fight. In addition, the doctors did not say that the injury he sustained was life-threatening.
